Terms and conditions
1. Binding agreement
These terms and conditions of sale (“Sale Terms”) constitute a binding agreement between Little Gems Trends (referred to in these Sale Terms variously as “We, Us, Our”) and its customers (referred to in these Sale Terms as “You, Your”) which applies to all purchases of items by You. You agree not to change these Sale Terms from the form presented by Us.
All other terms and conditions including those in any order submitted by You are expressly excluded and shall have no effect. All communications made thus far by Us are invitations to treat only. Your acceptance of these Sale Terms ordering the goods represents an offer of contract from You.
Our employees, agents or representatives are not authorised to make any representations concerning the goods supplied under these Sale Terms, unless such representations are confirmed in writing by an authorised representative at Little Gems Trends. Any errors or omissions in any catalogue, sales literature, price list, dispatch note, invoice or other documentation or any information issued by Us from time to time shall be subject to correction without liability on Our part.
You will be responsible for ensuring the accuracy of any order submitted by You, confirming where reasonably requested to
do so by Us, any telephone orders, and for the giving of such information as is necessary; relating to the Sale Terms and delivery (as the case may be) to enable Us to deliver the goods to the delivery address notified by You. When writing to Us, You must enter Your account number and purchase order number. Our agreement includes all correspondence between Us and You, and the descriptions of the goods as provided on Our Website or otherwise.
2. Prices and Payment
All prices stated in any of Our catalogues, price lists, or other sales literature may be altered by Us at any time without notice to You. The prices stated by Little Gems Trends shall be the current prices unless changed by Us in accordance with these Sale Terms.
Our agreement is made on the date We deduct payment from Your credit/debit card, the details of which You provided upon the order. Please bear in mind it may take a few days for your transaction to clear. When paying by cheque, please also allow 5 to 7 working days for this to be cleared before We are able to send Your items.
Please ensure You have accurately calculated the total cost of the items You wish to purchase upon ordering; and where necessary, to clarify anything regarding prices, contact us to query/confirm before making Your order. You are required to
pay for your goods in full by credit/debit card or cheque. Full payment will be expected with Your order. Please allow 5 to 7 working days from when Your payment is cleared before we can deliver Your items to the preferred specified delivery address which You have given Us. Where a credit/debit card or cheque has not cleared by 7 days, You will be notified and your account may be suspended, leaving your order subject to termination unless this is rectified right away. After this We reserve the right to keep You blacklisted. This may in turn also affect Your involvement with any of Our partners or sponsors too.
You agree and acknowledge that the transmission of Your credit/debit card number or other data in relation to payment for the goods shall be at your entire risk. Little Gems Trends under no circumstances bears any responsibility or liability in relation to failures in transmission of information, deletion, non-delivery, or failure to store any communications by you.
3. Delivery
We shall deliver the goods to the United Kingdom address notified to Us by You. We shall use all reasonable endeavours
to deliver the goods to the address supplied by You when You ordered the goods by any delivery date estimated by Us. For the avoidance of doubt and disappointment, You agree that the delivery date is not guaranteed or if the essence of the agreement between us under these Sale Terms and We shall in no circumstances be liable to You for any losses, damages, or charges incurred by You due to the late delivery of the goods.
Goods delivered to You shall be deemed accepted by You and You shall inspect the goods immediately and in all cases shall inform Us in writing within 5 days of delivery, of any damage, shortage, or non-delivery of the goods.
You agree to responsibility to bare the return cost of your product(s) should it need repairing. If a reduction or increase of links to adjust a bracelet is required, please return the item(s) within 1 month of ordering and I will alter for no further cost, except for the charge of return delivery by You. Any adjustments in size required after the 1 month of purchase, there will be an additional charge made by Us based on the time and labour of this work. You agree to full additional payment in this circumstance.
4. Title and Risk
Title in the goods shall not pass to You until We have received in full monies owed by You under this or any other agreement for the purchase of goods. Risk of damage to or loss of the
goods shall pass to You at the time of dispatch by Us, or if You wrongly fail to take delivery of goods at the time when We have tendered delivery of the goods to You.
5. Cancellation
No order which has been accepted by Us in accordance with the provisions of these Sale Terms may be cancelled by You except with the agreement in writing of an authorised representative of Little Gems Trends and on the terms that You may be required to indemnify Us in full for any costs, damages, losses, charges, and expenses including any loss of profit incurred by Us as a result of the cancellation.
6. Warranties and Limitations of Liability
Our liability for breach of these Sale Terms and any agreement between Us or negligence shall be limited at Our sole discretion to the free replacement of faulty items or the issue of credit
notes in respect thereof or the granting of a refund only to the actual items concerned, providing that You have not made any modifications to them. Except in respect of death or personal injury caused by Our negligence, We shall not be liable to You by any reason. Of any representation (unless fraudulent) or any implied warranty, condition or other term or any duty in common law or under the express terms of these Sale Terms for any indirect, incidental, or consequential loss or damages arising out of any services performed for You or any goods sold under these Sale Terms even if We have been advised of the possibility of such loss or damages. Except for cases of personal injury or death arising from Our negligence, the ‘Little Gems Trends’ liability to You for actual damages regardless of the form of action, will be strictly limited to the price of the goods sold.
New products sold by Us, will have 3 months return to base warranty. It will be ‘Your’ responsibility to bare the cost of the equipment should it need repairing. Please note, beads, charms wire and clasps that are deemed to have been damaged by ‘You’ and have not become faulty due to a manufacturing failure will incur a charge to ‘You’ for either the repair or replacement.
Please ensure that you take care to follow any aftercare instructions for the best, long-lasting performance in Your products. We will not be liable for any deliberate wear and tear or fading/discolouring where you have not looked after Your item(s), not following these aftercare instructions or where You may have left products in the sun for example in between wearing and not kept them safe in their gift boxes.
Please note that bracelet products include split rings for a secure and robust finish, however they can occasionally snag on certain clothes. It is Your responsibility to take this into consideration. We will not be liable for any damage that this may cause.
We warrant that you will be entitled to the benefit of any warranties or guarantee given by us of Your chosen products. You warrant that the information entered by you on any order forms, monetary contracts etc. are true. Where we sell to you under a consumer transaction Consumer Contracts (Information Cancellation and Additional Charges) Regulations 2013, Your statutory rights are not affected by this agreement.
7. Returns
Returns: You must contact Us if You think there is a fault so We can identify the problem. Only faulty products with a manufacturing fault(s) will be accepted for a replacement of the same product. All products are thoroughly checked before they are dispatched and believed to be accurate and reliable. It is essential that you take utmost care in your product(s) and are
also assured that any of our products that are given ownership by children/youth between 3 and 18, that they are responsible enough too, in this care given. Please ensure if You are giving an item to a young person, that they are also competent to look after such gift in the best way they can according to their age, maturity and understanding, based on your own knowledge and understanding in judgement. Upon purchasing, all buyers and recipients will be expected to carry out such measures, that there is no deliberate wear and tear made, for instance. All our products contain small parts so please take responsibility that no product should be given to a child below the age of 3, and also take utmost care when children of this age could be potentially exposed to such items within the ‘family’ unit. Goods returned with parts missing or that have been deemed to have been damaged by ‘You’ will NOT be covered under any warranty. It is Your responsibility to determine ‘fit for purpose’ before purchasing.
8. Indemnity
You agree to indemnify Us against all proceedings, costs, fees, expenses, payments, liabilities, losses and damages arising out of breach or negligent performance by You of any terms of these Sale Terms.
9. Force Majeure
We shall not be liable to You or be deemed to be in breach of these Sale Terms by reason of any delay in performing or any failure to perform any of Our obligations in relation to the goods, where the delay or failure was due to any cause beyond Our reasonable control.
9.1 Act of Nature: Explosions, Floods, Fire or Accident.
9.2 Act of Humans: War or threat of War, Sabotage, Civil Disturbance or Requisition.
9.3 Acts restrictions regulations bye-laws prohibitions or measures of any kind on the part of any governmental parliamentary or local authority;
9.4 Import or Export regulations or embargoes
9.5 Strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of Us or of a third party);
9.6 Power failure or breakdown in machinery.
10. Shipping Costs and Export or Import Licences
You shall be responsible for any shipping costs that may be involved when purchasing your items and for any returns where shipping costs may be concerned. Please check where applicable when shipping overseas, as well as in the UK. You shall also be responsible for obtaining all licences for export or import of the goods if necessary, and for obtaining any other licences required for the delivery or sale of the goods in the country.
11. Delivery and Postage
Please check carefully on any delivery costs for your items. All items which are posted will be made through Royal Mail 1st Class signed for or Special delivery (by 1 pm next day delivery) to ensure the safest delivery so please be aware of any extra costs this may incur. It will be your responsibility to avoid any disappointment. Small parcels from 99g will start from £5.50 for UK. Please double check on our website or enquire for any additional costs when ordering for overseas orders or any larger orders.
12. GDPR Data Protection
All information collected regarding addresses, phone numbers or any other contact information upon receiving orders, will be stored securely in a safe, and nothing passed on to any other partners or companies/organisations. Little Gems Trends takes great care when it comes to data protection and we want our customers to feel safe using our services. Personal information is just for reference and accounts purposes only. After 2 years has passed with no further sales/contact from you within our customer/business relations, your information will be destroyed with discretion and information collected again if any future customer/business involvement resumes; and the same process will repeat.
13. General
No waiver by Us of any breach of these Sales Terms by You shall be considered as a waiver of any subsequent breach of any provisions of these Sale Terms. If any provisions of these Sale Terms is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Sale Terms and the remainder of the provision in question shall not be affected. All notices served under these Sale Terms shall be in writing and shall be sent to the address set out in Our dispatch note, or to any later address in the United Kingdom notified for that purpose, and all notices sent by first class letter post or by Email shall be deemed to have been served immediately if they were sent by Email and on the second working day after posting if served by first class post. All of Our products are copyright, and the logos and designs remain the intellectual right of Little Gems Trends. These Sale Terms shall be governed by and construed in accordance with the laws of England and subject to the non-exclusive jurisdiction of the English Courts.
14. Tellephone Calls
Telephone calls may be recorded for quality control purposes.
15. Whole Agreement
The terms and conditions set out in this Agreement represents the entire Agreement.
Our terms and conditions including our delivery and return policies do not affect you
each visit and any purchases You make. These terms were last amended 8th February 2021.
